Terms of Use
1. Acceptance of Terms
By creating an account or using any part of the Synacl platform ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Synacl Labs (OPC) Private Limited, a company incorporated in India ("Synacl", "we", "us").
2. Description of Service
Synacl is a cloud-based IoT management platform that allows users to connect, monitor, and automate IoT devices and gateways. Features include real-time telemetry dashboards, rule-based automation, MQTT device integration, and analytics. Synacl is software only: we do not sell, ship or supply any hardware. You connect your own gateways, boards, meters and sensors.
3. Account Registration
You must provide accurate and complete information during registration and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@synacl.com if you suspect unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulations.
- Attempt to gain unauthorized access to any systems, networks, or data.
- Publish, transmit, or store malicious code, malware, or harmful data.
- Use the Service to send spam, phishing messages, or unsolicited communications.
- Infringe the intellectual property or other rights of others, or use the Service for fraud.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Exceed the device, message, or storage limits associated with your plan.
5. Plans, Billing and Refunds
Synacl offers a Free plan and paid plans. Each plan's features, limits and price are shown on the Plans page. Paid plans are billed in advance for each billing period, and taxes are added at checkout where they apply.
A paid subscription renews automatically at the end of each billing period until you cancel it. You can cancel at any time from your account settings. Cancelling stops future renewals, and your paid plan stays active until the end of the period you have paid for.
You can request a full refund within 14 days of any payment, whether it is your first payment or a renewal. Our Refund Policy explains how.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders, except orders paid in Indian rupees, which Synacl Labs (OPC) Private Limited bills directly through Razorpay. Paddle provides all customer service inquiries and handles returns for the orders it processes, and those orders are also subject to Paddle's Buyer Terms.
We reserve the right to modify pricing with 30 days' notice. Failure to pay may result in downgrade or suspension of your account.
6. Device and Telemetry Data
You retain ownership of all data generated by your devices and transmitted through the Service. By using the Service, you grant Synacl a limited license to process and store this data solely to provide the Service to you. We do not sell or share your device telemetry data with third parties.
7. Intellectual Property
The Synacl platform, brand, software, and all related materials are the exclusive property of Synacl Labs (OPC) Private Limited and are protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service. Synacl is not affiliated with any third-party template providers.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted access. Planned maintenance, hardware failures, or events beyond our control may cause downtime. We will make reasonable efforts to provide advance notice of planned maintenance.
9. Termination
You may delete your account at any time from the account settings page. We may suspend or terminate your account with or without notice if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination, your right to use the Service ends immediately and your data may be deleted.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Synacl and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice within the Service. Continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
