1. Acceptance of Terms
By creating an account or using any part of the Synacl platform ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Synacl Labs ("Synacl", "we", "us").
2. Description of Service
Synacl is a cloud-based IoT management platform that allows users to connect, monitor, and automate IoT devices and gateways. Features include real-time telemetry dashboards, rule-based automation, MQTT device integration, and analytics.
3. Account Registration
You must provide accurate and complete information during registration and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@synacl.com if you suspect unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulations.
- Attempt to gain unauthorized access to any systems, networks, or data.
- Publish, transmit, or store malicious code, malware, or harmful data.
- Use the Service to send spam, phishing messages, or unsolicited communications.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Exceed the device, message, or storage limits associated with your plan.
5. Plans and Billing
Synacl offers Free, Starter, Pro, and Enterprise plans. Plan features and limits are described on the Pricing page. Paid subscriptions are billed in advance and are non-refundable except as required by applicable law. We reserve the right to modify pricing with 30 days' notice. Failure to pay may result in downgrade or suspension of your account.
6. Device and Telemetry Data
You retain ownership of all data generated by your devices and transmitted through the Service. By using the Service, you grant Synacl a limited license to process and store this data solely to provide the Service to you. We do not sell or share your device telemetry data with third parties.
7. Intellectual Property
The Synacl platform, brand, software, and all related materials are the exclusive property of Synacl Labs and are protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service. Synacl is not affiliated with any third-party template providers.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted access. Planned maintenance, hardware failures, or events beyond our control may cause downtime. We will make reasonable efforts to provide advance notice of planned maintenance.
9. Termination
You may delete your account at any time from the account settings page. We may suspend or terminate your account with or without notice if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination, your right to use the Service ends immediately and your data may be deleted.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Synacl and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice within the Service. Continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
